BY ACCESSING OR USING THE SITE, CREATING AN ACCOUNT, OR PURCHASING MONETIZED CONTENT, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE PROVISIONS, DO NOT ACCESS OR USE THE SITE.

1. Eligibility & Age Restriction (18+ Mandatory)

YOU MUST BE AT LEAST 18 YEARS OF AGE (or the age of legal majority in your jurisdiction, whichever is higher) to access, register, or interact with DesireCrush.

By creating an account, you represent and warrant that:

• You are legally capable of entering into a binding contract.

• You are at least 18 years old.

• Accessing adult content is legal in the country or state from which you access the Site.

Minors are strictly prohibited. Accounts found to belong to individuals under the age of 18 will be terminated immediately without refund.

2. Access to the Site & User Accounts

• License: Subject to these Terms, DesireCrush grants you a personal, non-exclusive, revocable, non-transferable limited license to access and use the Site.

• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

• Prohibited Actions: You agree not to:

  • Reverse engineer, decompile, or disassemble any portion of the Site.

  • Use automated bots, scrapers, or scripts to collect data, create fake accounts, or manipulate platform interactions.

  • Resell, mirror, or commercially exploit any material or user content from the Site without explicit written authorization.

3. Content Creators & Monetization

DesireCrush allows verified users ("Creators") to share digital content, offer subscriptions, sell Pay-Per-View (PPV) media, and accept tips.

• Identity Verification (KYC): Creators must undergo identity and age verification prior to publishing or monetizing any adult or explicit content.

• Content Rights: Creators retain ownership of their original content. However, by uploading User Content to DesireCrush, Creators grant the platform a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content solely for operating and promoting the platform.

• Platform Fee: DesireCrush deducts a platform service commission (e.g., 10%) on all monetary transactions, subscription sales, and unlocks executed on the Site.

• Payouts & Withdrawals: Earnings accumulated in a Creator's wallet can be withdrawn subject to the minimum threshold and payout channels specified in the admin settings.

4. Acceptable Use Policy & Prohibited Content

While DesireCrush is an adult social creator platform, strict boundaries are enforced to protect users and comply with international regulations.

You agree NOT to upload, post, send, or request any User Content that:

1. Features or depicts any person under the age of 18.

2. Contains non-consensual sexual content, deepfakes without consent, or revenge media.

3. Promotes violence, illegal drugs, human trafficking, self-harm, hate speech, or physical violence.

4. Infringes on any third-party copyright, trademark, or intellectual property rights.

5. Involves unauthorized recording or sharing of private real-world information (doxxing).

DesireCrush reserves the right to review, edit, remove, or terminate any account or content that violates this Acceptable Use Policy without prior notice.

5. Payments, Subscriptions & Refunds

• Wallet Balance: Users can purchase internal digital balance/credits using supported payment options (including supported cryptocurrencies via third-party processors like CoinPayments).

• Finality of Digital Sales: Due to the instant-access nature of digital entertainment, all purchases, tips, subscriptions, and PPV unlocks are final and non-refundable, except where required by applicable law or platform discretion in cases of system errors.

• Chargebacks & Disputes: Initiating unauthorized chargebacks or fraudulent billing disputes will result in immediate and permanent account termination.

6. Intellectual Property & Copyright (DMCA / Takedown Policy)

DesireCrush respects copyright laws and protects original content creators.

If you believe your copyrighted work has been uploaded or shared on DesireCrush without authorization, please send a written takedown notice to our Copyright Agent containing:

1. Identification of the copyrighted work claimed to have been infringed.

2. Identification of the infringing material on the Site and sufficient details to locate it (URL / username).

3. Your contact information (name, address, telephone number, and email).

4. A statement of good faith belief that the material is unauthorized.

5. A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright holder.

7. Disclaimers & Limitation of Liability

• "As-Is" Service: The Site is provided on an "AS IS" and "AS AVAILABLE" basis. DesireCrush makes no warranties regarding continuous uptime, error-free operation, or absolute data preservation. You are advised to maintain personal backups of your uploaded content.

• Limitation of Liability: To the maximum extent permitted by law, DesireCrush shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the platform. In all events, DesireCrush's total liability shall not exceed fifty US Dollars ($50.00 USD) or the total amount paid by you to the platform in the preceding 6 months.

8. Indemnification

You agree to defend, indemnify, and hold harmless DesireCrush, its operators, officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Site, your User Content, or your violation of these Terms.

9. Account Termination

We reserve the right to suspend or permanently terminate your account and access to the Site at any time, for any reason, including any breach of these Terms, with or without prior notice.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with applicable laws. Any legal disputes, claims, or controversies arising out of or relating to these Terms or the use of DesireCrush shall be resolved on an individual basis through informal negotiation or binding dispute resolution, waiving any rights to class action lawsuits or jury trials.
